Pricing and Service
There are different costs charged by us based upon the type of claim you are making due to various Regulations in force.
We usually deal with cases on a Conditional Fee Agreement (CFA) - no win, no fee - as long as we consider you have reasonable prospects of succeeding in your claim. If you do not wish to enter into a CFA then we are able to proceed with your claim on a privately paying would apply.
The main points to note on entering into a Conditional Fee (or No Win-No Fee) Agreement are as follows:-
If you win…
We will charge you a success fee which is calculated as a percentage of the general damages (personal injuries) your claim is settled for. This is because we proceed with your claim on the basis that there is a risk we will not be paid at all if your claim fails.
Your opponent will have to pay for most, although probably not all, of our legal costs (excluding the success fee). If the amount recovered does not cover all or any of the costs then you will be required to pay the shortfall.
Our usual charging rate is based upon the seniority and experience of the file handler working:
£272.00 per hour – Solicitors or Chartered Legal Executives of at least 8yrs post-qualification (PQE)
£233.00 per hour – Solicitors or Chartered Legal Executives with at least 4yrs PQE
£189.00 per hour – Solicitors or Chartered Legal Executives with up to 4yrs PQE and other staff of equivalent experience
£133.00 per hour – Paralegals or trainees and Cost Draftsman
All hourly rates are exclusive VAT or any disbursements incurred on your behalf.
Disbursements will also be sought from your Opponent. As standard, we expect to incur disbursements for Medical Expert fees, Police fees, Barrister and Court fees.
Please bear in mind that under a Conditional Fee Agreement, Charles A Marshall Lawyers Limited is effectively sharing the risk of the matter with you and therefore this gives us a say in the way the matter should be run. The matter will be reviewed at appropriate stages and, if we do not then consider that we will succeed then we may decide to end the agreement. On a private basis, you are alone in the risk and therefore, decisions regarding progression of the case are largely yours alone. If you consider it is important to retain full control of the matter, rather than sharing control and the risk with us, then you need to take that into account when assessing the best funding option.
